This Copyright and Intellectual Property Notice is governed by New Zealand law, including the copyright act 1994.
Copyright Protection
All content created by Makayla Raynes, trading as Makayla Raynes Refined Art including but not limited to the website, drawings, text, photography, prints, digital imagery, designs, commissioned artwork, and branding is original work of Makayla Raynes, trading as Makayla Raynes Refined Art and is protected by the New Zealand and international Copyright laws.
Copyright protection is applied automatically in New Zealand, when original work is created. Registering for copyright is not required
Original Work
Makayla Raynes retains copyright of all original work created independently and offered for sale by Makayla Raynes Refined Art.
Purchase of any physical original work or prints does not transfer copyright to anyone, copyright still remains retained by Makayla Raynes. Purchasing of any physical original work does not give the clients/customer permission to reproduce or commercially exploit the artwork.
Commissioned Work
Makayla Raynes retains copyright of all commissioned work created by Makayla Raynes Refined Art.
Commissioned work created by Makayla Raynes Refined Art, it is agreed as a condition of accepting the booking that copyright in completed work is retained by Makayla Raynes. This includes any work paid for by the client from Makayla Raynes Refined Art.
Purchasing any physical original work, prints, or commissioned work does not give the clients/customer permission to reproduce or commercially exploit the work.
Makayla Raynes retains the right to reproduce commissioned artwork for purposes including prints, portfolios, website display, promotional purposes, social media, and advertising purposes.
All commissioned artwork and photography remain intellectual property of Makayla Raynes unless explicitly agreed to in writing. Upon full payment, the client receives ownership of the physical artwork only (if applicable).
Makayla Raynes retains full copyright, including the right to:
Reproduce work as prints or merchandise.
Share work for portfolios, marketing, and promotional purposes.
Publish work on websites, social media, and other platforms.
Clients may not reproduce or commercially use commissioned works without written permission.
Photography Work
Makayla Raynes retains copyright of all photography and imagery created in sessions or individually by Makayla Raynes Refined Art.
Purchase of any physical original work, photography, or booking of a photography session does not transfer copyright to anyone, copyright still remains retained by Makayla Raynes. Purchasing of any physical original work, photography or imagery does not give the clients/customer permission to reproduce or commercially exploit the artwork.
By booking a service or purchasing anything from Makayla Raynes Refined art or purchasing Makayla Raynes Creation of work, you have agreed that you have read and understood this copyright policy. (State that all works are the intellectual property of makayla raynes, trading as makayla raynes refined art.)
Art Prints
All art prints are reproductions of original works by Makayla Raynes and only sold for personal use. Purchasing a print does not transfer copyright or reproduction rights.
Forbidden use
Intellectual property of Makayla Raynes is copyright protected material owned by Makayla Raynes and it is forbidden to:
Reproduce or copy for any commercial purposes
Alter, trace, copy, reproduce, edit, derive works from any artwork created by Makayla Raynes.
Be used to create merchandise or create prints for sale
Represent it as another businesses or person's work
Exploit Makayla Raynes work in any way
Use for business or transactional purposes

Sell, distribute digital versions, mint, this is including but not limited to any NFT’s or similar technologies.
Legal action may be taken if unauthorised use, reproduction, distribution, or any of the above described but not limited to happens to any of Makayla Raynes work.

Artworks, graphics, photographs and written content on this website owned by Makayla Raynes are not to be reproduced, republished or used for commercial purposes.
You may share, display, and view works from the website providing full credit of work is given to Makayla Raynes Refined Art and no work is altered in any way, used for commercial use or republished without permission.
Sharing a link to the official website, or link to social media content is welcomed.
Moral Rights
Makayla Raynes retains moral rights in her original work, to the extent provided by the copyright act 1994.
Including but not limited to:
The right to be identified as a creator of her work.
The right to not have other people's work falsely credited to hers.
The right to oppose derogatory treatment of her work, that is detrimental to her reputation.
These rights are separate from copyright ownership, these are also applied as read, understood and agreed to by the client when a client books a service, purchases an item or piece of work, and or commission piece.
Ownership of Copyright
Under the New Zealand Copyright Act 1994 and applicable copyright laws and treaties, all intellectual property of Makayla Raynes and/or Makayla Raynes Refined Art unless explicitly agreed to in writing. Copyright is automatically assigned upon creation and does not require registration.
International Protection
This copyright notice applies worldwide under the international copyright agreements, including but not limited to the Berne Convention. All rights are reserved globally.
Enforcement
Any breach of this policy may result in legal action, including claims for damages, injunctions, and recovery of legal costs.
